Terms and Conditions of Travel Contract

Article 1 (The purpose of these terms and conditions is to specify the detailed implementation and compliance requirements for the travel contract concluded between T AND M TOUR and the traveler.

Article 2 (Duties of the Travel Agency and Traveler)

  1. The travel agency shall faithfully perform its duties in planning and executing travel arrangements, including travel mediation, guidance, transportation, and accommodation, to provide travelers with a safe and satisfactory travel service.

  2. Travelers shall actively cooperate with the travel agency in maintaining travel order and fostering harmony among travelers to ensure a safe and enjoyable trip.

Article 3 (Types and Definitions of Travel)

The types and definitions of travel are as follows:

  1. Customized Travel: A trip arranged by the travel agency according to the travel conditions desired by the traveler.

  2. Group Package Travel: A trip conducted by the travel agency by recruiting travelers based on pre-established travel conditions.

  3. Commissioned Package Travel: A package trip in which the travel agency entrusts the recruitment of travelers to another travel agency.

Article 4 (Components of the Contract)

  1. The travel contract consists of the travel contract document (attached), travel terms and conditions, and the travel itinerary (or travel description).

  2. The travel itinerary (or travel description) shall include the daily travel schedule, tourist attractions, transportation methods, number of shopping stops, accommodation details, meals, services provided by the travel agency, and traveler guidelines.

Article 5 (Special Terms and Conditions)

The travel agency and the traveler may agree on special terms in writing within the limits of applicable laws. In such cases, the travel agency must explain any differences from the standard terms and conditions to the traveler.

Article 6 (Delivery of Contract and Terms)

If a travel contract is concluded, the travel agency shall provide the traveler with one copy of the contract, the travel terms and conditions, and the travel itinerary (or travel description).

Article 7 (Deemed Delivery of Contract and Terms)

The contract, terms, and itinerary (or travel description) shall be deemed delivered to the traveler in the following cases:

  1. If the traveler applies for the travel contract after agreeing to the contents provided electronically (via the internet, etc.), and the travel agency notifies the traveler of its acceptance through an electronic information network or mechanical device.

  2. If the travel agency provides the contract, terms, and itinerary (or travel description) via fax or other mechanical device, and the traveler submits a written application for the contract after agreeing to its contents, and the travel agency notifies its acceptance electronically or via a mechanical device.

Article 8 (Liability of the Travel Agency)

  1. The travel agency is liable for any damages caused to the traveler due to intentional misconduct or negligence by itself, its employees, local travel agencies, or their employees in the course of performing their duties as specified in Article 2, Paragraph 1.

  2. The travel agency shall compensate the traveler for damages incurred due to flight, train, or ship delays or traffic congestion. However, this does not apply if the travel agency proves that it was not at fault.

  3. The travel agency must exercise due care in the receipt, delivery, and storage of the traveler’s baggage. If the travel agency’s negligence results in the loss or damage of baggage, it shall compensate for the resulting damages.

Article 9 (Cancellation Due to Minimum Participation Requirement Not Being Met)

  1. If the minimum required number of participants is not met, the travel agency must notify the traveler at least 24 hours before departure for a one-day trip and at least 48 hours before departure for trips lasting two or more days.

  2. If the travel agency fails to notify the traveler within the aforementioned period and cancels the contract due to insufficient participation, it shall refund the full deposit and compensate the traveler with an additional 50% of the deposit amount.

Article 10 (Rejection of Contract Conclusion)

The travel agency may refuse to enter into a contract with a traveler in the following cases:

  1. If the traveler is likely to cause inconvenience to other travelers or significantly hinder the smooth execution of the trip.

  2. If it is deemed difficult for the traveler to travel due to illness or other reasons.

  3. If the maximum number of participants specified in the contract has been exceeded.

Article 11 (Travel Fees)

  1. The basic travel fee includes the following:

    • Transportation fares (airplane, ship, train, etc.) based on standard fares

    • Shuttle bus fees between airports, train stations, ports, and hotels

    • Accommodation and meal fees

    • Guide fees

    • Various travel-related taxes

    • Domestic airport and port usage fees

    • Admission fees for tourist attractions in the itinerary

    • Other costs agreed upon separately

  2. The traveler must pay a deposit (up to 10% of the travel fee) upon contract signing. The deposit is treated as part or all of the travel fee or as compensation for damages.

  3. The remaining balance must be paid to the travel agency by the day before departure.

  4. The travel fee must be paid using a method designated by the travel agency (credit card, international transfer, domestic bank transfer, etc.).

  5. If traveler’s insurance is included in the travel fee, the travel agency must inform the traveler of the insurance company and coverage details.

Article 12 (Conditions for Travel Changes and Fee Adjustments)

  1. Travel conditions may only be changed in the following cases:

    • If necessary for the traveler’s safety or protection and agreed upon by both parties due to local circumstances.

    • If the travel purpose cannot be achieved due to force majeure, such as natural disasters, war, government orders, or strikes by transportation or accommodation providers.

  2. If a change in travel conditions results in an increase or decrease in travel costs, adjustments must be made before departure for pre-departure changes and within 10 days after the trip for post-departure changes.

Article 13 (Cancellation Before Departure)

  1. Either party may cancel the contract before departure. In such cases, compensation for damages shall be in accordance with the "Consumer Damage Compensation Regulations" issued by the Ministry of Economy and Finance.

  2. No compensation is required if cancellation occurs due to:

    • Force majeure (natural disasters, war, strikes, etc.)

    • The traveler's illness or a family member’s hospitalization/death

    • The travel agency’s failure to provide the itinerary as agreed upon

Article 14 (Termination After Departure)

  1. If unavoidable circumstances arise after departure, either party may terminate the contract, but compensation for damages shall be required.

  2. The travel agency shall assist the traveler in returning home, and the traveler shall bear the cost unless the travel agency is at fault.

Article 15 (Start and End of Travel)

Travel starts at departure and ends when the traveler reaches the final destination. Exceptions apply in case of changes to the contract or itinerary.

Article 16 (Duty to Explain)

The travel agency must explain the key terms and any changes to ensure the traveler understands them.

Article 17 (Insurance Subscription)

The travel agency must subscribe to an insurance or deposit a business guarantee fund to compensate for any damages incurred by the traveler.

Article 18 (Miscellaneous)

  1. Matters not specified in this contract shall be determined by mutual agreement between the travel agency and the traveler. If no agreement is reached, applicable laws and general practices shall apply.

  2. Special travel destinations may have different terms and conditions.

Cancellation Policy

Refunds will be issued after deducting the applicable cancellation fee:

  • Day Tours & Admission Tickets

    • 3 days prior: 30% deduction

    • 2 days prior: 50% deduction

    • 1 day or same-day cancellation: No refund

  • DLX Tours

    • 5 days prior: Full refund

    • 4–2 days prior: 10% deduction

    • 1 day or same-day cancellation: 30% deduction

  • Medical Tourism

    • 7 days prior: Full refund

    • 6–3 days prior: 10% deduction

    • 1 day or same-day cancellation: No refund

  • Closed on Saturdays, Sundays, and public holidays in Korea.
